Awesome Creatives Sdn. Bhd. (Company No. 202501047977 / 1649385-P) (“Awesome Creatives”, “we”, “us”, “our”) is committed to protecting your personal data. This Privacy Notice explains how we collect, use, disclose, and safeguard personal data in accordance with the Personal Data Protection Act 2010, as amended by the Personal Data Protection (Amendment) Act 2024 (collectively, the “PDPA”). It applies to personal data we collect through awesomecreatives.org, the channels we operate (including the Geekception channels on YouTube, Instagram, and TikTok), and our commercial dealings.
2. Personal Data We Collect
We collect personal data you provide directly to us, including:
- contact details (name, email, phone, company);
- enquiry and project information you submit through our website or by email;
- commercial information necessary to enter into and perform agreements (banking details, tax identification, billing addresses);
- communications you send us and our responses;
- content you submit, including comments and tagged content on our channels.

3. Purposes for Which We Use Personal Data
We process personal data for the following purposes:
- to respond to your enquiries and provide information you request;
- to negotiate, enter into, and perform agreements with you or your organisation;
- to issue invoices, receive payment, and meet tax and accounting obligations;
- to send service communications and, where you have consented, marketing updates;
- to operate, maintain, and improve our website and channels;
- to comply with applicable laws and respond to lawful requests from authorities;
- to establish, exercise, or defend legal claims.
4. Legal Basis
We process personal data on the following bases under the PDPA: your consent; performance of a contract with you; compliance with a legal obligation; and our legitimate interests in operating our business, where these are not overridden by your rights.
5. Disclosure of Personal Data
We do not sell personal data. We disclose personal data only to:
- service providers that support our business, such as cloud storage, accounting, payment processing, and IT (each bound by confidentiality and data protection obligations);
- professional advisers, including auditors, lawyers, and tax agents;
- regulatory authorities, where required by law;
- a successor entity in the event of a corporate reorganisation, merger, or sale, in which case this Notice continues to apply.
6. International Transfers
Some of our service providers (including cloud storage and email infrastructure) are located outside Malaysia. Where we transfer personal data outside Malaysia, we do so in accordance with the PDPA and rely on provider-level safeguards including contractual protections and recognised certifications.
7. Retention
We retain personal data only as long as necessary for the purposes set out in this Notice. Specifically: commercial records for seven (7) years following the end of the relevant financial year, in line with the Income Tax Act 1967 and the Companies Act 2016; enquiry data for up to two (2) years if no engagement results; marketing data until you withdraw consent. Anonymised data may be retained indefinitely.
8. Your Rights
Under the PDPA, you have the right to: request access to your personal data; request correction of inaccurate data; withdraw consent to processing (which may affect our ability to provide services to you); request that we limit or stop processing; and lodge a complaint with the Personal Data Protection Commissioner. To exercise any right, contact us using the details in Section 11. We respond within twenty-one (21) days, in line with the PDPA.
9. Security
We maintain appropriate technical and organisational measures to protect personal data against unauthorised access, alteration, disclosure, or destruction. These measures include access controls, encryption in transit, and provider-level safeguards on cloud services. No security measure is perfect, and we cannot guarantee absolute security.
10. Children
Our services are not directed to children under eighteen (18). We do not knowingly collect personal data from children. If you believe a child has provided us with personal data, please contact us and we will delete it.
